1. Agreement
These terms are an agreement between you and NOVRILL INC., a Wyoming corporation ("we", "us"), the operator of Banana Art Lab (also called NanoBanana). They cover trynanobanana.net, the canvas and the MCP server for AI tools (together, the "service"). By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.
2. Who can use it
You must be at least 13 years old. If you are under 18, or under the age of majority where you live, you may use the service only with a parent's or guardian's permission. You may not use it if the law where you live forbids it.
3. Your account
- Keep your password safe. You are responsible for what happens in your account.
- This includes what apps you connect, or anyone holding your API keys, do with it.
- Tell us right away if you think someone else is using your account.
- We may suspend or close accounts that break these terms.
4. Credits and payments
- Free credits. New accounts get 10 free credits that do not expire.
- Credit packs. We sell one-time credit packs, charged in US dollars through Stripe. There is no subscription and no automatic renewal.
- Expiry. Purchased credits are valid for 30 days from the purchase. Credits are spent in order of expiry, earliest first.
- Prices. Each generation costs the number of credits shown on the site before you generate. We may change prices, but a change never affects credits already charged.
- Failed generations. If a generation fails, the credits it used are returned to your balance automatically. Credits that would never have expired still never expire, and other returned credits stay valid for at least as long as they would have before.
- What credits are. Credits are not money. They cannot be transferred, sold or exchanged for cash, except as described under refunds.
- Refunds. Within 14 days of buying a credit pack, you can ask for a full refund of that pack if none of its credits have been used. Email support@trynanobanana.net from your account's email address. Other purchases are non-refundable, except where the law requires a refund.
5. Using the service responsibly
You may not use the service to create, upload or share content that:
- sexualises minors in any way, or shows real people in sexual or intimate situations without their consent;
- harasses, threatens or bullies anyone, or promotes violence or hatred against people because of who they are;
- impersonates a real person, or deceives people into believing that an image is real when it is meant to mislead (for example fake news, fraud or election misinformation);
- infringes anyone's copyright, trademark, privacy or other rights;
- is illegal where you live, or breaks the usage policies of the AI model providers.
You also may not:
- try to break into, overload or get around the limits of the service;
- resell access to it;
- copy its content in bulk with automated tools;
- use automated access other than our API and MCP server.
The model providers' safety filters may refuse some prompts; when that happens, your credits are returned. We may remove content and suspend accounts that break these rules, and we report child sexual abuse material to the authorities.
6. Your content
Your inputs. You keep the rights to the prompts and images you give us. You promise that you have the right to use them. This includes having permission from anyone who appears in a photo you upload. You give us permission to store, process and send them to model providers so we can provide the service. If you publish an artwork, you also let us show it, with its prompt, in the gallery and on public pages.
Generated images. As between you and us, the images generated for you are yours: we claim no ownership of them, and any rights we may have in them we give to you. Your use of them is also subject to the terms of the model provider that made them and to the law where you live. You let us store them and show them where you choose to publish them. AI models can produce similar images for different people, so we cannot promise that an image is unique or that nobody else has rights in something similar. You are responsible for how you use the images, including checking that a use is allowed before you use an image commercially.
Copyright complaints. If you believe content on the service infringes your rights, email support@trynanobanana.net. Include the content's address, the work it infringes, and how we can reach you.
7. AI tools you connect
You can connect apps such as Codex, Claude Code or Cursor, or use API keys. They act for you: they can generate images with your credits and read and change your canvases. You are responsible for what they do until you disconnect them in Canvas Settings → AI tools. Those apps are made by other companies, and their own terms apply to them.
8. Other companies' services
Image generation relies on models from other companies, such as Google, OpenAI, ByteDance and Alibaba. Banana Art Lab is independent and is not affiliated with or endorsed by them. Models may change, become slower or be removed, and their providers' terms may also apply to how you use their output.
9. Changes and availability
We keep improving the service. We may add, change or remove features and models. We try to keep the service available, but cannot promise it will always work without interruption.
10. Disclaimers
The service and everything it generates are provided "as is". AI output can be wrong, unexpected or offensive. To the extent the law allows, we make no promises about the service, including that it is fit for a particular purpose or that it does not infringe anyone's rights.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or data. Our total liability to you is limited to the greater of what you paid us in the 12 months before the claim, or US$50. Nothing in these terms limits liability that the law does not allow to be limited.
12. Indemnity
If someone makes a claim against us because of content you created or uploaded, or because you broke these terms, you agree to cover our reasonable costs of that claim.
13. Ending
- You. You can stop using the service at any time. To delete your account, see the Privacy Policy.
- Us. We may suspend or close your account if you break these terms, or if we must do so by law.
- Credits. If we close the service, we will give notice and refund unused purchased credits that are still valid. If we close your account because you broke these terms, unused credits are not refunded.
14. Governing law
These terms are governed by the laws of the State of Wyoming, United States, and disputes go to the state or federal courts located in Wyoming. If you are a consumer, you keep any protections that the law where you live gives you.
15. Changes to these terms
We may update these terms. We will change the date at the top, and tell you on the site or by email about important changes before they apply. If you keep using the service after that, you accept the new terms.
